Legislation

This Legal Notice and its terms and conditions will be governed and interpreted in accordance with Spanish law. By simply accessing the website or registering as a user, the User irrevocably gives their consent to the competent Courts by default, to hear any legal action arising from or related to these conditions or the use or browsing of this website. If any provision or section of these General Conditions, which is not essential to their existence, is declared void or unenforceable, the validity of the remaining provisions will not be affected.

Internal Information System

In accordance with the provisions of Law 2/2023, dated February 20th, regulating the protection of individuals who report regulatory breaches and combat corruption, Mediterráneo Servicios de Gestión Integral SAU has established an Internal Information System for the following individuals: employees of the company, including after the employment relationship has ended; interns and trainees; candidates who have participated in any selection process for the company; self-employed individuals; representatives of the employees; shareholders and persons belonging to the company's governing or management body, and individuals who provide services for the company through contracting and subcontracting arrangements.

Responsibility of the Communities and Obligations of the Administrators

Article 10.1, a) of the Horizontal Property Law (LPH) establishes as a legal obligation for the Communities of Property Owners to carry out ‘the necessary works and repairs for the proper maintenance and fulfillment of the duty of conservation of the property and its common services and facilities, including, in any case, those necessary to meet the basic requirements of safety, habitability, and universal accessibility, as well as aesthetic conditions….’ Similarly, the said legal text establishes the obligations of each owner (Article 9) as well as that of each of the community’s governing bodies: president, vice president, secretary, and administrator.

Specifically referring to the property administrator, it is highly relevant that they have professional training and specialization in managing the common elements or real estate of a community of property owners. Their functions and powers, as listed in Article 20 of the Horizontal Property Law, are as follows::

  • Ensure the good order of the house, its facilities and services, and make the appropriate warnings and reprimands to the owners for these purposes.
  • Prepare in advance and submit to the Assembly the plan of foreseeable expenses, proposing the necessary means to meet them.
  • Attend to the conservation and maintenance of the house, arranging for urgent repairs and measures, and immediately informing the president or, if applicable, the owners.
  • Execute the agreements made in terms of works and carry out the payments and collections that are appropriate.
  • Act, if applicable, as the secretary of the Assembly and keep the community’s documentation available to the owners.
  • All other powers conferred by the Assembly.
